SMS Policy

By using the Kubilo platform, you agree to this policy.
This SMS Policy explains how Kubilo and the restaurants ("Merchants") using our platform collect and use mobile phone numbers, send text messages, and process opt-in and opt-out requests. It supplements our Privacy Policy and Terms of Service.
1. Who sends SMS through Kubilo
Kubilo operates a messaging platform that sends transactional and promotional text messages on behalf of independent restaurants ("Merchants") that use Kubilo's order management software. Each text message is sent from a U.S. 10-digit local phone number registered with carriers under Kubilo's A2P 10DLC compliance program. Twilio Inc. is our messaging provider.
The body of every text message clearly identifies the Merchant on whose behalf the message is sent.
2. When you may receive an SMS from us
(a) Order-status messages (transactional). If you place an order with a Merchant — through QR code, website, phone, or in-person — Kubilo may send you order-status updates such as "order accepted", "ready for pickup", or "delivery on the way". These are transactional messages necessary to fulfill your order and do not require separate opt-in beyond placing the order.
(b) Promotional messages (require explicit opt-in). You will receive promotional messages from a Merchant ONLY if you have: visited a Merchant-specific promotional landing page (such as the "Scratch & Win" game on a Kubilo receipt QR code); affirmatively checked an unchecked-by-default consent checkbox bearing the legally required text; and submitted the form bearing that consent.
We record the exact consent language you saw, your IP address, your user-agent, and the timestamp of your opt-in. This record is retained as a TCPA audit log.
3. Message frequency and cost
Promotional message frequency varies by Merchant campaign. Typical volume is 1-4 messages per month per Merchant you have opted in with.
Message and data rates may apply from your wireless carrier. Kubilo does not charge you for SMS. Standard text messaging rates apply based on your wireless plan.
4. How to opt out
Reply STOP to any text message you receive from us. Your opt-out is processed in real time by Twilio, our messaging provider, and synchronized to Kubilo's database within seconds.
You will receive one confirmation message confirming your unsubscription, after which no further promotional messages will be sent to your phone for the Merchant whose campaign you unsubscribed from. Opting out from one Merchant does not affect opt-ins for other Merchants you may have separately opted in to.
5. How to opt back in
If you have previously opted out, you may opt back in by replying START to a previous Kubilo message, or by visiting any Merchant promotional landing page and completing the opt-in flow again.
6. How to get help
Reply HELP to any text message to receive an automated response with contact information. For non-automated help, email contact@kubilo.com.
7. Discount codes delivered by SMS
Some promotional campaigns include a redemption code delivered by SMS. These codes are personal to you and bound at issuance to the phone number you opted in with.
Codes are non-transferable and may not be sold, traded, or used by any other phone number. They are subject to expiration as stated in the SMS message; expired codes cannot be reactivated.
Codes may have minimum order requirements as stated in the SMS message. At order time, the redeeming phone number is validated against the code's bound phone number; if there is a mismatch, redemption will be refused.
Codes are one-time-use; successful redemption marks the code as consumed.
8. Data we store, and for how long
For each phone number that opts in to a Merchant campaign, we store: the phone number (in E.164 format); the Merchant ID and campaign ID; the exact consent text shown at opt-in; your IP address at opt-in; your browser user-agent at opt-in; the opt-in timestamp; any opt-out timestamps and reasons; and the history of messages sent and delivery status.
These records are retained as long as you remain opted in, plus a reasonable period thereafter for audit purposes (typically two years after opt-out). You may request a copy or deletion of your records at any time by emailing contact@kubilo.com.
9. Sharing
Kubilo does NOT share, sell, or rent your phone number to any third party for marketing purposes. Phone numbers are shared only with: Twilio Inc., our SMS infrastructure provider, solely for delivering your messages; the Merchant whose campaign you opted in with, who needs to know the list of opted-in subscribers; and law-enforcement agencies pursuant to a valid legal order.
10. Children
Kubilo's SMS services are not directed at children under the age of 13. We do not knowingly accept opt-ins from children. If you believe we have inadvertently subscribed a child, please email contact@kubilo.com and we will delete the record immediately.
11. Changes to this policy
We may update this SMS Policy as carrier regulations, Twilio requirements, or applicable law evolves. The "Last updated" date at the top of this page reflects when the policy was last revised.
